Terms and Conditions
These are our terms and conditions.
Please read them carefully as they are designed to reassure you of our duties and responsibilities toward you as our client.
From time to time this will be updated in keeping with the ever-changing climate of the wedding industry.
A £20 booking fee secures your date in my diary for celebration cakes. A £100 booking fee secures your date in my diary for wedding cakes. This fee is a non-refundable administration fee; it covers all communications with the client, illustrations and one standard cake sample box in the case of a wedding booking.
All quotations are individually calculated according to your design and cake size. All quotations are valid for 24 hours
Each cake is made individually by hand. Due to the bespoke nature of baking, cake decoration techniques and copyright restraints variations will occur. As part of the design process, any photographs of other cakes will be used for reference only. We cannot guarantee an exact replica of any cake, colour matches or true likeness of people, animals, flowers or any other object to be made into cake decorations, but every effort is made to ensure as much consistency as possible.
It is the responsibility of the client to inform us of any food intolerances/allergies at the time of ordering. Allergens can be removed from our recipes, however, our kitchen is not 100% ”free from” as our products are prepared in an environment where nuts, egg, milk, gluten and other allergens may be present. We recommend that the client source a specialist supplier for severe allergies.
It is the responsibility of the client to make immediate contact with us via email or letter to discuss any design alterations after an accepted invoice and deposit have been made. Any/all alterations will only become effective once written confirmation from Anesha’s Art of Cakes has been received.
We reserve the right to use whole/partial images of our creations on social media or websites without compensation.
If the client would like fresh flowers instead of sugar flowers, it will be the client’s responsibility to source the florist/flowers. The client acknowledges that fresh flowers are not a food product and may contain contaminants such as insects, dirt and pesticides. It is the client’s responsibility to source food-safe flowers. We will arrange the flowers on the cake unless otherwise discussed. Anesha’s Art of Cakes cannot be liable for any contamination of our food products that may arise from their misuse. We recommend that the florist liaise directly with us to confirm details about the size of the cake being dressed to avoid any miscommunication.
From time to time certain materials for our cakes may become obsolete. This is totally out of our control; however, we will do our best to select replacement products to reflect the original design as closely as possible. We reserve the right to replace items with component parts of equal or better quality without consultation.
It is the client’s responsibility to confirm their acceptance of the final invoice, agree to the terms and conditions and fulfil any payment requests before an order is officially considered placed.
Our portion guide is an approximation only and will vary based on how the cake is cut.
Wedding portions are classed as 1”x1” slices and Party portions are classed as 1”x2” slices.
A full payment where requested secures your agreed cake design at the invoice price and order release date. Payments are due 31 calendar days for wedding cakes and 14 calendar days for celebration cakes
All orders for biscuits, cupcakes, brownies, cakesicles, cake truffles, samples and any item from our online shop are to be paid in full at the time of order.
We will require full payment on any order should it be accepted within 31 calendar days from the order release date.
The deposit is a non-refundable and transferable payment, as this accounts for resources allotted to your order prior to your event date e.g. administration, emails, phone calls, consultations, materials, ingredients and decorations.
Any design alterations after the accepted invoice and deposit are negotiable this may affect the agreed invoice price. No alterations are valid unless written confirmation from Anesha’s Art of Cakes has been received. The adjustment in cost will be applied to the outstanding balance.
If the payment is not received a final notice will be sent via email. If no further written correspondence or payment is received from you the client within 24hrs of final notice, we will consider the order cancelled and the deposit will be retained.
Hire of Cake Stand/Accessories
Cake stands and other accessories to compliment your cake are available for hire. A cake stand hire fee of £25 alongside a £75 security bond against loss or damage is required. The security bond is refunded upon return of the stand as long as it is in the same condition as it has been let out. The security bond will be retained should loss or damage occur or if the item has not been returned in two (2) days from the wedding date
A box with our company details will be left with the venue alongside packaging to ensure the stand is protected.
At the venue, photographs and a video of the stand will be taken to show the condition at set up.
By paying this stand hire fee you are agreeing to the terms and conditions of hire. It is your responsibility to ensure the item/s is returned to our premises within 2 calendar days from the order release date. Please enquire for details.
All cancellations must be made by the client in writing (letter or email).
For wedding cake cancellations within six months of the wedding date, 50% of the whole order value will be invoiced; for cancellations within three months 75% of the total order value will be invoiced: for cancellations within one month 100% of the total order value will be invoiced. As Anesha’s Art of Cakes will have turned down other orders in favour of yours, this is compensation for lost revenue..
We reserve the right to retain all funds paid if any celebration cake commission is cancelled within 14 calendar days of the due date.
Cake orders can be rescheduled if the date suits Anesha’s Art of Cakes. Otherwise postponing your cake order will be treated as a cancellation.
Refund requests will be assessed per individual case and awarded at our discretion.
All refunds will be issued in the form of Anesha’s Art of Cakes vouchers unless otherwise agreed in writing.
Collection, Delivery and Set-Up
Cake collection is at 10 am or 2 pm on the order release date from our premises 30 Blyth Rd, Worksop, Nottinghamshire, S81 0HW unless otherwise agreed.
All collections are made from the front door. This is due to insurance and health and safety requirements.
All cakes require a signature of acceptance on delivery/collection.
Our cakes are stacked and dowelled onto a sturdy board to ensure their stability during transport. We advise that you place your boxed cake onto a non-slip mat in a clean and empty car boot or footwell. NEVER place a cake on a car seat or person’s lap.
Delivery and setup are available and are calculated on mileage (0.50p per mile) and commitment of time basis (£15 per hour).
Cakes that are above 10 inches in height with significantly fragile decorations will automatically include delivery and set up as part of the quotation and invoice.
Collection and delivery must be arranged at the time of booking.
Changes to collection and delivery arrangements may be possible but cannot be guaranteed.
It is the client’s responsibility to ensure all arrangements are made prior to order arrival e.g. sturdy table, table cloth, lighting and other decorations etc.
Cakes and their decorations are very fragile. We cannot be held liable for any damage to a cake or its decorations after it has left our possession.
Storage and Consumption
Our cakes are homemade and do not have the extended shelf life of supermarket cakes. We advise that your cake be consumed within 24hrs of the order release date to ensure freshness and quality. Any taste and texture issues reported after this period will be invalid.
Refrigeration or freezing of sugar paste cakes is not advised as it accelerates staling and changes the appearance and texture of the icing.
Our cakes must be stored at the correct temperature and in the box we supplied, out of the sun and away from damp conditions or heat.
Cake decorations are fragile and must be handled with care if the client wishes to preserve any as keepsakes e.g. bride and groom toppers and flower bouquets.
The client is responsible for removing non-edible items before serving, e.g. ribbons, toppers, dowels, floral wires and picks, etc.
All our cakes go through slicing, taste and texture quality control testing prior to decoration. All cakes are photographed after decoration. Our home kitchen is subject to spot inspections and has all the relevant standards in place to protect our clients and ourselves.
If you have any concerns about the appearance of your cake, please notify us at the time of order release. Where possible we will endeavour to rectify the problem.
All other issues must be immediately notified in writing accompanied by photographic evidence. 90% of the uneaten product must be returned to us within 24 hours of the release date so that we may fairly assess the nature of the complaint.
No refunds or compensations are issued due to change of mind, personal taste dislikes, mistakes made by the client i.e. incorrect/misspelt names and choice of cake, factors beyond our control i.e. damages made by kitchen, venue or guests at your event.
We shall not be held liable for any failure to perform due to circumstances outside our control e.g. traffic conditions, mechanical failure, weather conditions, obstruction of roads, riot, government act, act of war or terrorism, act of God etc. If we are unable to fulfil your order for any reason we will endeavour to find another supplier who can help and reimburse any funds already paid.
Refund vouchers are given at the discretion of Anesha’s Art of Cakes.
We reserve the right, at our discretion, to review and modify any of our terms and conditions at any time without notice.
